The Eviction Process in Texas
DFW Property Management handles the full Texas eviction process when necessary — from issuing the 3-day notice to vacate through court filing, judgment, and writ of possession. Our Platinum package covers court filing fees up to $750, minimizing financial exposure for property owners in Dallas-Fort Worth.

Notice to Vacate
When a tenant falls behind on rent or violates lease terms, we serve a formal 3-day Notice to Vacate as required by Texas Property Code. This notice is delivered in person or posted on the door and mailed via certified mail.

Eviction Suit Filed
If the tenant fails to comply with the notice, we file an eviction suit (forcible detainer) at the Justice of the Peace court in the precinct where the property is located. Filing includes all required documentation and proper service of citation.

Court Hearing
The court hearing is scheduled within 10-21 days of filing. We coordinate with our eviction attorney to represent your interests. If the tenant fails to appear, a default judgment is typically entered in the landlord's favor.

Judgment & Writ of Possession
After a favorable judgment, we request a Writ of Possession if the tenant has not vacated. The constable posts a 24-hour notice, then supervises the lockout. We coordinate the entire process and secure the property afterward.

Property Recovery & Re-Leasing
After regaining possession, we assess the property condition, coordinate any needed repairs, and begin the re-leasing process immediately. We document all damages for potential security deposit claims and pursue any outstanding balances.
Court-Fee Coverage (Platinum)
Our Platinum package covers court filing fees up to $750 for uncontested evictions of tenants we placed. This covers:
- Notice to vacate preparation and service
- Court filing fees
- Attorney consultation and representation
- Process server fees
- Writ of possession filing
- Post-eviction property securing

Eviction FAQ
How long does the eviction process take in Texas?
In Texas, the eviction process typically takes 3-6 weeks from the notice to vacate through final court judgment. After a 3-day notice to vacate is served, we file an eviction suit if the tenant fails to comply. The court hearing is usually scheduled within 10-21 days. If the tenant appeals, the process can take longer. DFW Property Management handles every step to minimize delays.
What court fees are covered on the Platinum package?
Our Platinum package covers court filing fees up to $750 for uncontested evictions of tenants we placed. This includes the notice to vacate preparation, court filing fees, attorney coordination, and process serving. The protection applies to tenants who passed our 5-point screening and were placed by our team.
What is the eviction rate for DFW Property Management tenants?
Our eviction rate is less than 1% across our entire portfolio. This exceptionally low rate is the direct result of our rigorous 5-point tenant screening process, which includes credit, criminal background, income, eviction history, and identity verification, with exact thresholds published per property in our rental criteria.
When can a landlord evict a tenant in Texas?
In Texas, a landlord can begin eviction proceedings when a tenant fails to pay rent, violates lease terms, holds over after lease expiration, or engages in criminal activity on the property. Texas law requires a written notice to vacate (minimum 3 days for nonpayment) before filing an eviction suit. DFW Property Management ensures all legal requirements are met to protect your interests.
